1. Legal Basis of the Contract
These Terms and Conditions of Travel shall form an integral part of the travel contract between Tickwell GmbH and the customer.
They supplement Sections 651a et seq. of the German Civil Code (BGB) and the disclosure requirements under Articles 250 and 251 of the Introductory Act to the German Civil Code (EGBGB).
These terms apply regardless of whether the booking is made online, by phone, in writing, or through a travel agency.
A package tour is defined as a situation in which Tickwell offers and sells at least two different travel services (e.g., a ticket and accommodations) for a total price. Individual agreements take precedence over these terms and conditions.
2. Registration and Confirmation
1. By registering, the customer makes a binding offer to enter into a travel contract.
2. Registration may be made on behalf of multiple participants; the person registering is liable for their obligations, provided that he or she has expressly agreed to do so.
3. The contract is concluded upon acceptance by Tickwell, which is confirmed by a travel confirmation (including via email).
4. If the confirmation differs from the registration, it is considered a new offer that is binding for 10 days.
5. Intermediaries are not authorized to make any different commitments.
3. Services
1. The scope and nature of the services are set forth in the trip description and the trip confirmation.
2. Any side agreements or special requests must be confirmed by Tickwell.
3. Third-party services (e.g., excursions, concert or sports tickets) are not part of the travel contract if they are expressly identified as such. Tickwell acts as an intermediary for these services on behalf of the service provider.
4. For sporting events (e.g., soccer games), responsibility lies solely with the organizer; Tickwell is liable only for acting as an intermediary.
4. Payment
1. Payments are made only upon presentation of a
Certificate of Security Permitted under Section 651r of the German Civil Code (BGB).
2. Upon receipt of the travel confirmation and the confirmation of booking, a 30% deposit is due, payable within one week.
3. The balance must be paid no later than 40 days before the start of the trip, without further notice.
4. If payment is not made by the due date despite a reminder and the setting of a deadline, Tickwell may withdraw from the contract and charge cancellation fees in accordance with Section 7.
5. Accepted payment methods: bank transfer, credit card, PayPal, Stripe.
5. Travel Documents
The customer is required to check the travel documents for accuracy immediately upon receipt. Any errors must be reported right away. If the documents are not received at least 5 days before the trip begins, the customer must contact Tickwell.
6. Price Changes
1. Tickwell may increase the travel price if transportation costs, taxes, or exchange rates rise after the contract is concluded.
2. An increase is permitted only up to 20 days before the start of the trip.
3. If the price increase exceeds 8%, the customer has the right to cancel the trip at no cost or to request an equivalent alternative trip.
7. Cancellation by the Customer
1. The customer may cancel at any time before the trip begins. The date on which Tickwell receives the notice is decisive.
2. Tickwell may demand reasonable compensation. Unless otherwise agreed, the following flat rates per person apply:
Up to 60 days before the start of the trip: 30%
59–30 days: 40%
29–22 days: 45%
21–15 days: 60%
14–7 days: 85%
6 days or more / No-show: 95%
3. Different cancellation policies apply to tickets for events and services provided exclusively by third parties (up to 100%).
4. The customer reserves the right to prove that no damage occurred or that the damage was less than claimed.
8. Rescheduling and Substitute Participants
1. Changes to reservations are possible up to 30 days before departure for a fee of €50 per person, plus any additional costs incurred. After that, the only option is to cancel and make a new reservation.
2. The customer may designate a substitute participant up until the start of the trip (Section 651e of the German Civil Code (BGB)). Tickwell may charge a €60 processing fee for this, plus any additional costs.
3. Changes to bookings for third-party services are subject to the terms and conditions of those services.
9. The Customer’s Obligations to Cooperate
1. Any issues must be reported immediately to Tickwell or the tour guide so that they can be resolved.
2. If the notice of defects is not provided through the customer’s own fault, any claims for a price reduction or damages shall be forfeited.
3. Damage to luggage during air travel must be reported immediately to the airline (PIR); deadlines: 7 days for damage, 21 days for delays.
10. Withdrawal/Termination by Tickwell
1. Tickwell may cancel the trip before it begins if the minimum number of participants is not reached (up to 30 days in advance) or if the customer fails to pay despite a reminder.
2. Tickwell may terminate the contract after the trip has begun if the customer significantly disrupts the trip or acts in breach of the contract.
11. Force Majeure
In the event of unavoidable, extraordinary circumstances (natural disasters, political unrest, pandemics), either party may terminate the contract. Additional costs for return transportation will be shared; the customer is responsible for any other additional costs.
12. Liability
1. Tickwell is liable for careful preparation, accurate specifications, and proper performance.
2. Liability is limited to three times the travel price—except in cases of death, bodily injury, or harm to health—if the damage was not caused by willful misconduct or gross negligence.
3. Tickwell is not liable for third-party services if they are clearly identified as such.
13. Passport, Visa, and Health Requirements
Tickwell informs EU citizens about the general regulations.
The customer is personally responsible for complying with entry, vaccination, and health regulations.
Any disadvantages resulting from failure to comply shall be borne by the customer, unless Tickwell provided incorrect information.
14. Filing a Claim & Statute of Limitations
1. Claims regarding travel defects must be filed with Tickwell within one month after the contractual end of the trip.
2. Claims for bodily injury or damage to health are subject to a 2-year statute of limitations; all other claims are subject to a 1-year statute of limitations, in each case beginning on the day after the contractual end of the trip.
15. Data Protection
Personal data is processed solely for the purposes of contract fulfillment and customer service. Details are set forth in the Privacy Policy.
16. Choice of Law and Jurisdiction
1. German law applies.
2. The customer may sue Tickwell only at its place of business.
3. Tickwell may only sue customers in the jurisdiction where they reside; for non-consumers, the place of jurisdiction is Tickwell’s registered office.
17. Severability Clause
The invalidity of any individual provision shall not affect the validity of the remaining provisions.
