1. contractual bases

These travel conditions become part of the travel contract between Tickwell GmbH and the customer.
They supplement Sections 651a et seq. of the German Civil Code (BGB) and the information obligations pursuant to Art. 250/251 EGBGB.
They apply regardless of whether the booking is made online, by telephone, in writing or via a travel agency.

A package tour exists if Tickwell offers and sells at least two different travel services (e.g. ticket and accommodation) at a total price. Individual agreements take precedence over these terms and conditions.


2. registration and confirmation

  1. By registering, the customer makes a binding offer to conclude a travel contract.

  2. The registration can be made for several participants; the applicant is liable for their obligations if he has expressly accepted this.

  3. The contract is concluded upon acceptance by Tickwell, which is declared by travel confirmation (also by e-mail).

  4. If the confirmation differs from the registration, it is considered a new offer that is binding for 10 days.

  5. Intermediaries are not authorized to make any promises to the contrary.


3. services

  1. The scope and nature of the services are set out in the travel description and the travel confirmation.

  2. Additional agreements and special requests require confirmation by Tickwell.

  3. Third-party services (e.g. excursions, concert or sports tickets) are not part of the travel contract if they are expressly marked as such. Tickwell arranges these on behalf of the service provider.

  4. In the case of sporting events (e.g. soccer matches), responsibility lies solely with the organizer; Tickwell is only liable for arranging the event.


4. payment

  1. Payments may only be made against delivery of a surety bond in accordance with § 651r BGB.

  2. After receipt of the travel confirmation and the security certificate, a deposit of 30% is due, payable within one week.

  3. The balance must be paid at the latest 40 days before departure without further request.

  4. If payment is not made on time despite a reminder and the setting of a deadline, Tickwell may withdraw from the contract and demand cancellation costs in accordance with Section 7.

  5. Accepted payment methods: bank transfer, credit card, PayPal, Stripe.


5. travel documents

The customer is obliged to check the travel documents for correctness immediately upon receipt. Any errors must be reported immediately. If the documents are not received at least 5 days before the start of the trip, the customer must contact Tickwell.


6. price changes

  1. Tickwell may increase the travel price if transportation costs, taxes or exchange rates increase after conclusion of the contract.

  2. An increase is only permitted up to 20 days before the start of the trip.

  3. If the increase exceeds 8%, the customer has the right to withdraw free of charge or to demand an equivalent replacement trip.


7 Withdrawal by the customer (cancellation)

  1. The customer can withdraw at any time before the start of the trip. The date of receipt of the declaration by Tickwell is decisive.

  2. Tickwell may demand reasonable compensation. Unless otherwise agreed, the following flat rates per person apply:

  1. Different cancellation rules apply to tickets for events and pure third-party services (up to 100%).

  2. The customer reserves the right to prove that no or less damage has been incurred.


8. rebooking and substitute participants

  1. Changes to bookings are possible up to 30 days before departure for a fee of €50 per person plus any additional costs incurred. Thereafter only by withdrawal and rebooking.

  2. The customer can provide a substitute participant up to the start of the trip (§ 651e BGB). Tickwell may charge a processing fee of € 60 plus additional costs for this

  3. Changes to bookings for third-party services are subject to their terms and conditions.


9 Obligations of the customer to cooperate

  1. Defects must be reported immediately to Tickwell or the tour guide so that remedial action can be taken.

  2. If the notification of defects is culpably omitted, claims for reduction or compensation shall lapse.

  3. Baggage damage during air travel must be reported to the airline immediately (PIR); deadlines: 7 days in the event of damage, 21 days in the event of delay.


10. withdrawal/termination by Tickwell

  1. Tickwell may withdraw before the start of the trip if the minimum number of participants is not reached (up to 30 days in advance) or if the customer does not pay despite a reminder.

  2. Tickwell may terminate the contract after the start of the trip if the Customer disrupts the execution of the trip or behaves in breach of contract.


11. force majeure

In the event of unavoidable, exceptional circumstances (natural disasters, political unrest, pandemics), both parties may terminate the contract. Additional costs for return transportation shall be shared, other additional costs shall be borne by the customer.


12. liability

  1. Tickwell is liable for careful preparation, correct service description and proper performance.

  2. Liability is limited to three times the travel price - except in the case of injury to life, limb or health - if the damage was caused neither intentionally nor through gross negligence.

  3. Tickwell is not liable for third-party services if these are clearly marked as such.


13. passport, visa and health regulations

Tickwell informs EU citizens about the general rules.
The customer is responsible for compliance with entry, vaccination and health regulations.
Any disadvantages resulting from non-compliance shall be borne by the Customer, unless Tickwell has provided incorrect information.


14. filing of claims & limitation period

  1. Claims due to travel defects must be asserted against Tickwell within one month of the contractual end of the trip.

  2. Claims for bodily injury/health damage lapse after 2 years, all other claims after 1 year, in each case from the day after the contractual end of the trip.


15. data protection

Personal data is processed exclusively for contract processing and customer service. Details can be found in the privacy policy at https://tickwell-travel.de/datenschutz.


16 Choice of law and place of jurisdiction

  1. German law applies.

  2. The Customer may only sue Tickwell at its registered office.

  3. Tickwell may only sue Customers at their place of residence; in the case of non-consumers, the place of jurisdiction is Tickwell's registered office.


17. severability clause

The invalidity of individual provisions shall not affect the validity of the remaining provisions.
